Sousa, José Vieira de2024-04-232024-04-232019-03-22https://hdl.handle.net/20.500.14135/1015The thesis addresses the established relation between quality and regulation within the scope of the National System for the Evaluation of Higher Education (Sinaes) and used the method of dialectical historical materialism, using, based on it, the methodological categories totality, contradiction and mediation. Its general objective was to investigate how the quality relates to the Sinaes regulation policy in the Law courses in the Federal District (DF) evaluated by the National Student Performance Exam (Enade) in the 2015 evaluation cycle. The current legislation on higher education does not discuss the definition of quality, corroborating the idea of the polysemy of its concept. The regulation of higher education, in turn, is carried out by the State, being subsidized by the evaluations of Sinaes but, over the years, this category was intensified by virtue of the creation of the quality indicators, inserted in the system by means of Ordinances. As a result, the type of research chosen was the exploratory one, from which a qualitative approach was adopted, using semi-structured interviews and documentary analysis as instruments and procedures for data production. Regarding the selection criteria of the group of Higher Education Institutions (HEIs) selected for the research, we analyzed the Institutions with headquarters in the DF that offered the Law course and that had Enade Grade and Preliminary Course Grade (CPC) referring to the year of 2015. We elected seven of the 18 Higher Education Institutions (HEIs), following three criteria: academic organization and administrative category, size of HEIs according to the number of courses offered and the amount of the monthly tuition fee at the time of data production. Regarding the subjects interviewed, we chose three from each institution, the coordinator, the teacher and the student of the Law course, as well as individuals representing the Secretariat for Regulation and Supervision of Higher Education (Seres), the Higher Education Evaluation Board of the National Institute of Studies and Research Anísio Teixeira (Daes-Inep) and the Brazilian Association of Higher Education Holders (ABMES), and one belonging to the Brazilian Bar Association (OAB). For data analysis, we used content categories – quality, assessment, regulation, expansion and student profile. During the analysis of the interviews, Web Qualitative Data Analysis (webQDA) software was used. The results of the research demonstrated that the regulation assumed a prominent role in Sinaes, making the evaluation a supporting element, thus weakening the purpose of quality assessment and promotion. The way in which Sinaes has been configured over the years has contributed to the regulation aiming at quality control and its operationalization, ultimately neglecting the formative nature of the evaluation. The indicators of the system are fragile and fail to capture the complexity and the heterogeneity of higher education and the particularities of the law course. In addition, we found that the link established between evaluation and quality is contradictory, since the evaluations of the State are recognized by the research subjects, but under the character of the obligatoriness. Regarding Sinaes quality indicators, it was verified that the subjects belonging to the HEIs investigated, especially the teachers and some course coordinators, understand little about the subject, given its complexity. With regard to expansion, the increase in the number of courses and enrollments, the competition, which motivated a dispute between the private HEIs in the Federal District, the Program to Support the Plans for Restructuring and Expansion of Federal Universities (Reuni), allied to the Program University for All (Prouni) and the Student Financing Fund (Fies), contributed, over the years, to break the hegemony of a student profile that was entering the DF Law courses.
