In the 1990s, the theme of independent regulation has begun to gain prominence in Brazil, influenced by the American and European experiences, the country was surrounded by a series of structural changes, such as redemocratization, the failure of the Interventionist State and the processes of privatization and reform of the State. The study seeks to highlight the legal elements that characterize the special regime of these regulatory bodies and whether the Executive Branch respects these prerogatives, because since 2001, regulatory agencies have been the target of constant bills, decrees and legal opinions aiming to reduce their powers and autonomy.
